CAR SUIT

Funny Barbados News BlogTHE CONTROVERSY over the impounding of a number of used vehicles at the Bridgetown Port has taken a new turn. One of the importers has sued the port in an attempt to have its fleet of vehicles, said to be worth over $1.6 million, released. Shazar Distributors Inc., a subsidiary of Mohammed Motors, with offices in Belleville, St Michael, has filed an urgent application with the High Court asking for a judicial review of the port's action.... The suit, which named the Attorney-General and Comptroller of Customs as parties, is claiming that the actions of the Comptroller of Customs were unauthorised and contrary to law, and that they exceeded the comptroller's jurisdiction and breached the principles of natural justice. The suit also claimed that the comptroller acted unreasonably in the exercise of his discretion; that he acted on irrelevant considerations and that he failed to satisfy or observe conditions or procedures required by law. In addition, the suit has called for an injunction forcing the comptroller to deliver the vehicles out of the port; an order saying that the comptroller's decision to hold the vehicles was invalid and an order of prohibition preventing him from deferring or delaying "without just cause" the delivery of the vehicles. The suit is also asking for costs and damages and that they be paid by the Attorney-General and Comptroller of Customs. Director/shareholder Dr Abdul Mohamed told the DAILY NATION yesterday that about 18 Toyota pick-up trucks worth at least $90 000 each, brought in by the company, had been impounded since December when the first batch arrived.
